CCMA mandatory jab ruling ‘unprecedented’: NEASA

The National Employers Association of South Africa (NEASA) says a CCMA ruling against a woman fired by her employer for not taking the jab is unprecedented.
The woman appealed her dismissal and sought reinstatement or to be fully compensated.
However, the CCMA ruled that her dismissal was fair as she refused to take part in creating a safe work environment.
The association's Gerhard Papenfus says the decision, called an arbitration award, only leaves unanswered questions on whether mandatory vaccinations are lawful and reasonable.

"The award by the CCMA will without a doubt influence the decision by many employers who dismiss employees who refuse to vaccinate.
"Our advice, however, is that employers must take caution that this award doesn't diminish the risk to employers to have an adverse finding made against them should they wish to follow this route."
